For example, a concerned adult child may petition the court to appoint the child as the guardian of an aging parent.

When a concerned family member petitions the court to establish a guardianship or conservatorship for a loved one, other individuals may try to contest the application, or seek to challenge an existing guardianship or conservatorship. Allegations of financial mismanagement or other abuse and neglect by the guardian or conservator may be alleged.

Litigation may be required to address a number of other probate issues, such as the reformation of a will or a trust.
