Laws And Regulations Applicable In Adjudicating Claims For Veterans Benefits

Title 38 of the United States Code. This is the section of the codified laws of the United States that applies to benefits provided through the Department of Veterans Affairs (VA). The United States Code is a compilation and codification of the general and permanent federal laws of the United States.

Section 38 of the Federal Regulations. This section of the Federal Regulations contains the regulations that describe the process of adjudicating claims for service-connected VA compensation benefits, non-service connected, needs-based VA pension benefits and other benefits that are adjudicated by VA personnel.

General Counsel Opinions. The VA’s General Counsel issues written legal opinions having conclusive effect on all VA officials and employees in adjudications and appeals involving veterans benefits claims.

M21-1 and M21-MR is the adjudication manual used by VA adjudicators. The manual contains over 3,000 pages and, like the other laws and regulations set forth above, is available on-line.
